The FDA just released results from its investigation into dark chocolates claiming to be milk or dairy free. The results showed that 4 companies manufactured and sold dark chocolates with sufficient enough milk to lead to an allergic response.
The terms "dairy-free" or "milk-free" are not regulated. The only absence claim that is regulated is gluten-free. However, claiming to be milk or dairy free and then containing milk, is false advertising and could put consumers who are allergic to milk at risk.
I recommend that if you make a product claim, you have paperwork to back it up!
